Introduction
These general terms and conditions apply to the vehicle rental agreement entered into with FORMENTERA MOTOR, S.L. (hereinafter FORMOTOR) and constitute a contract between You (hereinafter “the Customer”) and:

The vehicle rental agreement implies full and unreserved acceptance of these general terms and conditions, together with the specific terms of the selected rate and the regulations applicable in each case.
We therefore recommend that you read these terms and conditions before requesting or formalising your booking and each time you access our website.
Legal framework
These general terms and conditions are governed by the applicable laws of Spain.
Terms and conditions
The vehicle rental agreement is subject to the following terms and conditions:

Conditions and warnings
The vehicle may only be driven by the hirer named in this contract or by those persons expressly authorised on the front of this contract, who must be at least 23 years old and, for 4-wheel vehicles, hold a valid driving licence and have held it for a minimum of 3 years. For 125cc scooters, it is essential to hold an A1 licence or to have held a category B driving licence for at least 3 full years. Previous riding experience is essential for motorbike rental. If, once the agreement has been entered into, it is confirmed that there is no such experience, the vehicle will be withdrawn with no refund.
Required documents
The following must be presented at all times in order to rent any vehicle:
- Original valid driving licence. An international driving permit is also required for citizens who are not members of the EU.
- Credit card as a deposit in the name of the driver. DINERS CLUB and AMERICAN EXPRESS credit cards will not be accepted as a deposit.
Booking holder and payment method
The booking must be made in the name of the main driver, who will be the person named in the rental agreement. The credit card used for payment and the deposit must also be in the driver’s name. Third-party cards will not be accepted. FORMOTOR reserves the right not to complete the rental if these requirements are not met.
Vehicle availability
Vehicles are assigned by group or category, not by specific model, make or colour. FORMOTOR will provide a vehicle with similar characteristics to the group booked, subject to availability at the time of delivery. Images are for guidance only. Requests for a specific model or particular features cannot be guaranteed and will be subject to availability.
Excess
The excess is the maximum amount the Hirer will be liable for in the event of damage caused to the vehicle during the rental period.
This amount will be handled by credit card:
For rentals of less than 7 days: an amount corresponding to the excess will be blocked.
For rentals of 7 days or more: this amount will be charged and refunded when the vehicle is returned, provided it is returned in the same condition.

Super Insurance is an optional service that reduces the Hirer’s liability by removing payment of the excess for damage to the vehicle. A security deposit of €150 for cars and €20 for motorbikes will also be blocked.
This option expressly excludes damage caused to the underbody, roof and windows of the vehicles. Missing items are also excluded: objects or any other element from the interior of the vehicle; as well as the loss of equipment, such as keys, controls, helmets or any other accessory.

Protection for the windscreen, windows, lights, tyres and wheel rims. Price: €30.25 per rental. 4×4 and 4×4 elite categories are excluded from this option.
Coverage exclusions (not included in any insurance)
Under no circumstances will any type of insurance or cover include the following:
- Damage to the underside of the vehicle
- Damage to the roof
- Windows
- Missing or damaged objects or items from inside the vehicle
- Loss of or damage to keys, controls or accessories
- Incorrect fuel use
- Damage arising from improper use, negligence or breach of the contract terms
These cases will always be the responsibility of the Hirer, regardless of the cover taken out.
Charges (Optional)
- Baby seat/Maxi-Cosi: €5.00/day up to a maximum of €50.00
- Booster seat: €4/day up to a maximum of €40.00
- Additional driver: Price €4/day, up to a maximum of €40
- Out-of-hours delivery: €30
- Home delivery/collection: €25 per trip
* We provide service up to the ferry arriving at 23:30h
Fuel policy
The vehicle must be returned with the same fuel level as at the start of the rental. Otherwise, the missing fuel will be charged together with an additional refuelling service charge, according to the current rate and depending on the vehicle group. In all cases, there will be a charge of €200 for incorrect fuel use, payable by the customer/hirer.
- Refuelling: €8 for 2-wheel vehicles / €20 for 4-wheel vehicles
- Incorrect use: €200
If the vehicle is returned with more fuel than at the start, this amount will be refunded according to the market fuel price in force at that time.
Charges for improper use
- Loss of 50cc helmet: €21
- Loss of 125cc helmet: €40
- Loss of or damage to 50cc scooter key or non-coded key: €20.
- Loss of or damage to coded scooter key up to 125cc: €90.
- Loss of or damage to coded remote key for H.Visión or H. SH:184.66€
- Loss of bicycle lock key: €6.
- Loss of lock: €12.
- Loss of car key: €200.00
- Incorrect fuel use in 4-wheel vehicles: €200.
- Call-out charge in case of lost keys: €15.
- Vehicle towing: €80.
- Return of the vehicle with wet seats: €50.
- Extra cleaning if the vehicle is returned in EXTREMELY dirty condition: €100.
- Vespa primavera /LX mirrors: €70.
- 50cc scooter mirrors: €30.
Booking time and actual rental period
The rental period will be governed by the date and time stated in the booking, which will determine the start and end of the contract. In the event of a delay in collecting the vehicle by the Hirer, the rental period will not be changed, and the conditions and duration set out in the original booking will remain in force in all cases.
This condition is based on operational planning and vehicle availability. Return conditions may be adjusted at the time of formalising the contract, by prior agreement between the parties, which may entail changes to the rental price.
Vehicle delivery/return policy
At the time of delivery of the vehicle, the company will provide the customer with an initial vehicle condition report showing any minor damage the vehicle may have, as well as the fuel level and mileage. The customer must sign this report and attach it to the rental agreement, thereby accepting the vehicle’s initial condition by signature, which may be checked together if the customer so requests. On the final day, when the vehicle is returned, the company will carry out another inspection to check its condition. The customer may request a copy of the inspection report stating whether or not any damage is present and detailing such damage.
Extension of the rental agreement
If the Hirer wishes to extend the rental period, they must:
- Request the extension at least 24 hours before the end of the contract.
- Go to a FORMOTOR office to arrange it.
- Pay the amount corresponding to the additional period.
- Sign a new rental agreement or an addendum to the original agreement.
Any extension will always be subject to vehicle availability.
If the vehicle is not returned on the agreed date and time without the extension having been formalised, the current rate for the extra days plus a penalty surcharge will apply.
FORMOTOR reserves the right to refuse an extension request for operational reasons.
Invoice requests
The Hirer may request an invoice for the rental service. In order for it to be issued, full tax details must be provided at the time of formalising the booking or contract.
FORMOTOR shall not be liable for invoicing errors resulting from incorrect or incomplete details provided by the customer.
The invoice will be issued electronically and sent to the e-mail address provided by the customer.

Price and payment
- The conditions, the price of the services and the accepted payment methods are those expressly stated on the page where you make your booking.
- The Customer expressly authorises FORMOTOR to make the charges provided for in the rate conditions, for example to cover possible penalties for late cancellation or no-show.
- Promotions and offers shall only be valid for as long as they remain accessible to service users.
- Unless specifically stated otherwise, the prices shown on the Website are Retail Prices, VAT included (21%).
- The transaction will be carried out in EUROS, regardless of the Customer’s origin.

Modification or cancellation
Unless otherwise specified in the rate conditions set out on the page from which the booking is requested or formalised, you may cancel or modify your booking free of charge up to 48h before vehicle collection by contacting rent@formotor.com.
If the cancellation is made within the 48 hours prior to the vehicle collection day, you will forfeit 50% of the amount paid in advance.
In the event of cancellation less than 24h before vehicle collection, you will forfeit 100% of the amount paid in advance.

Right of withdrawal
For the purposes of article 97.1.i) of Royal Legislative Decree 1/2007, you are hereby informed that, pursuant to article 103 l) of the aforementioned Royal Decree-Law, you do not have the right of withdrawal.

Invalidity
If one or more of the clauses included in these general terms and conditions is declared wholly or partially null and void or ineffective, this shall affect only that provision or the part so declared, and the general terms and conditions shall remain in force in all other respects, with such provision or the affected part thereof deemed not to have been included.

Acceptance
Requesting and formalising the booking necessarily implies that each and every one of these general terms and conditions, considered as an integral part of the booking and completed by the rate conditions and the applicable specific legislation, are expressly accepted by you.

Applicable law
This contract shall be governed by Spanish law, to the exclusion of its conflict of law rules. Without prejudice to the rights granted to consumers regarding jurisdiction by Royal Legislative Decree 1/2007 of 16 November, any dispute that may arise from the use of the Website or the services linked to it shall be submitted to the jurisdiction and competence of the Courts and Tribunals determined according to FORMOTOR’s registered address, with the Customer expressly waiving any other jurisdiction that may correspond to them.
