(hereinafter FORMOTOR)<\/strong><\/p>\n<ul>\n<li>Registered address: La Savina, 07870 Formentera (Balearic Islands), Spain<\/li>\n<li>Tax ID No.: B07609951<\/li>\n<li>La Savina Office Tel. &#8211; 0034 971 32 29 29<\/li>\n<li>Es Cal\u00f3 Office Tel. &#8211; 0034 971 32 70 48<\/li>\n<li>Workshop Tel. &#8211; 0034 971 32 22 42<\/li>\n<li>e-mail &#8211; <a href=\"mailto:rent@formotor.com\">rent@formotor.com<\/a><\/li>\n<\/ul>\n<p> The vehicle rental agreement implies full and unreserved acceptance of these general terms and conditions, together with the specific terms of the selected rate and the regulations applicable in each case.<\/p>\n<p>We therefore recommend that you read these terms and conditions before requesting or formalising your booking and each time you access our website.<\/p>\n<h2>Legal framework<\/h2>\n<p> These general terms and conditions are governed by the applicable laws of Spain. <\/p>\n<h2>Terms and conditions<\/h2>\n<p> The vehicle rental agreement is subject to the following terms and conditions: <\/p>\n<ol>\n<li>\n<h3>Conditions and warnings<\/h3>\n<p> The vehicle may only be driven by the hirer named in this contract or by those persons expressly authorised on the front of this contract, who must be at least 23 years old and, for 4-wheel vehicles, hold a valid driving licence and have held it for a minimum of 3 years. For 125cc scooters, it is essential to hold an A1 licence or to have held a category B driving licence for at least 3 full years. Previous riding experience is essential for motorbike rental. If, once the agreement has been entered into, it is confirmed that there is no such experience, the vehicle will be withdrawn with no refund. <\/p>\n<h4>Required documents<\/h4>\n<p> The following must be presented at all times in order to rent any vehicle: <\/p>\n<ul>\n<li>Original valid driving licence. An international driving permit is also required for citizens who are not members of the EU.<\/li>\n<li>Credit card as a deposit in the name of the driver. DINERS CLUB and AMERICAN EXPRESS credit cards will not be accepted as a deposit.<\/li>\n<\/ul>\n<h4>Booking holder and payment method<\/h4>\n<p> The booking must be made in the name of the main driver, who will be the person named in the rental agreement. The credit card used for payment and the deposit must also be in the driver\u2019s name. Third-party cards will not be accepted. FORMOTOR reserves the right not to complete the rental if these requirements are not met. <\/p>\n<h4>Vehicle availability<\/h4>\n<p> Vehicles are assigned by group or category, not by specific model, make or colour. FORMOTOR will provide a vehicle with similar characteristics to the group booked, subject to availability at the time of delivery. Images are for guidance only. In the event of a delay in collecting the vehicle by the Hirer, the rental period will not be changed, and the conditions and duration set out in the original booking will remain in force in all cases.<\/p>\n<p>This condition is based on operational planning and vehicle availability. Return conditions may be adjusted at the time of formalising the contract, by prior agreement between the parties, which may entail changes to the rental price.<\/p>\n<h4>Vehicle delivery\/return policy<\/h4>\n<p> At the time of delivery of the vehicle, the company will provide the customer with an initial vehicle condition report showing any minor damage the vehicle may have, as well as the fuel level and mileage. The customer must sign this report and attach it to the rental agreement, thereby accepting the vehicle\u2019s initial condition by signature, which may be checked together if the customer so requests. On the final day, when the vehicle is returned, the company will carry out another inspection to check its condition. The customer may request a copy of the inspection report stating whether or not any damage is present and detailing such damage. <\/p>\n<h4>Extension of the rental agreement<\/h4>\n<p> If the Hirer wishes to extend the rental period, they must: <\/p>\n<ul>\n<li>Request the extension at least 24 hours before the end of the contract.<\/li>\n<li>Go to a FORMOTOR office to arrange it.<\/li>\n<li>Pay the amount corresponding to the additional period.<\/li>\n<li>Sign a new rental agreement or an addendum to the original agreement.<\/li>\n<\/ul>\n<p> Any extension will always be subject to vehicle availability.<\/p>\n<p>If the vehicle is not returned on the agreed date and time without the extension having been formalised, the current rate for the extra days plus a penalty surcharge will apply.<\/p>\n<p>FORMOTOR reserves the right to refuse an extension request for operational reasons.<\/p>\n<h4>Invoice requests<\/h4>\n<p> The Hirer may request an invoice for the rental service. In order for it to be issued, full tax details must be provided at the time of formalising the booking or contract.<\/p>\n<p>FORMOTOR shall not be liable for invoicing errors resulting from incorrect or incomplete details provided by the customer.<\/p>\n<p>The invoice will be issued electronically and sent to the e-mail address provided by the customer.<\/li>\n<li>\n<h3>Price and payment<\/h3>\n<ul>\n<li>The conditions, the price of the services and the accepted payment methods are those expressly stated on the page where you make your booking.<\/li>\n<li>The Customer expressly authorises FORMOTOR to make the charges provided for in the rate conditions, for example to cover possible penalties for late cancellation or no-show.<\/li>\n<li>Promotions and offers shall only be valid for as long as they remain accessible to service users.<\/li>\n<li>Unless specifically stated otherwise, the prices shown on the Website are Retail Prices, VAT included (21%).<\/li>\n<li>The transaction will be carried out in EUROS, regardless of the Customer\u2019s origin.<\/li>\n<\/ul>\n<\/li>\n<li>\n<h3>Modification or cancellation<\/h3>\n<p> Unless otherwise specified in the rate conditions set out on the page from which the booking is requested or formalised, you may cancel or modify your booking free of charge up to 48h before vehicle collection by contacting rent@formotor.com.<\/p>\n<p>If the cancellation is made within the 48 hours prior to the vehicle collection day, you will forfeit 50% of the amount paid in advance.<\/p>\n<p>In the event of cancellation less than 24h before vehicle collection, you will forfeit 100% of the amount paid in advance.<\/li>\n<li>\n<h3>Right of withdrawal<\/h3>\n<p> For the purposes of article 97.1.i) of Royal Legislative Decree 1\/2007, you are hereby informed that, pursuant to article 103 l) of the aforementioned Royal Decree-Law, you do not have the right of withdrawal.<\/li>\n<li>\n<h3>Invalidity<\/h3>\n<p> If one or more of the clauses included in these general terms and conditions is declared wholly or partially null and void or ineffective, this shall affect only that provision or the part so declared, and the general terms and conditions shall remain in force in all other respects, with such provision or the affected part thereof deemed not to have been included.<\/li>\n<li>\n<h3>Acceptance<\/h3>\n<p> Requesting and formalising the booking necessarily implies that each and every one of these general terms and conditions, considered as an integral part of the booking and completed by the rate conditions and the applicable specific legislation, are expressly accepted by you.<\/li>\n<li>\n<h3>Applicable law<\/h3>\n<p> This contract shall be governed by Spanish law, to the exclusion of its conflict of law rules.
